Mumbai: Senior citizen gets justice after 7 years

The suburban Mumbai's additional consumer dispute redressal forum recently granted relief to a senior citizen Bholenath Bhojane who was cheated by a trust named Senior Citizen Trust. The forum thus asked the trust to pay back the invested money of Rs 4.77 lakhs along with 10 percent interest on it, till the time the entire money was paid. The forum also asked the trust to pay an additional amount of Rs 30,000 towards the complainant's mental agony along with Rs 10,000 towards the ligation charges.

The case dates back to the year 2009, when Bhojane, a resident of Mahim, had entered into a deal with the trust for selling his bungalow and shifting to a flat built by the trust. The deal was finalised at Rs 4.77 lakhs and same was paid accordingly. However, the trust did not hand over the possession of the flat. Bhojane sought for the possession a number of times, but it did not respond.

Finally the complainant sent a legal notice, but even the same went unanswered, he thus approached the consumer forum.

The forum asked the trust to file a reply, but it didn't turn up. The forum, thus after going through the evidence on record, held that the trust, which was formed for the senior citizens and held the trust responsible for providing faulty services to its consumer, thus penalising the trust for the same.
