Mumbai: Four sons told to pay up in maintenance case

In an unusual case, the Thane court directed the Navghar police to attach the movable property of the four sons of a senior citizen and directed them to pay the Rs 72,250 each as maintenance to their father.

The court, in its order received by the police on April 16, asked the police to attach the movable property of all the four children of Faujdar Gaud, 75, a resident of Bhayander and if the said sum is not paid within eight days, the police have been authorised to sell the movable property to pay for the maintenance to Gaud.

According to Gaud, his four children requested him to give his three bedroom flat in Mira Road to them to live. The children in return promised to pay EMI for the said flat which their father was paying and only around Rs 70,000 was remaining. They also promised to pay the rent for the flat so that he can look after himself.

Gaud said, "On their request, I gave my flat to my children in 2015. They promised to clear the flat's pending EMI and also pay rent. But they neither paid the EMIs which has now doubled nor did they pay me rent. They also did not bother to pay maintenance or tax for the flat. They once tried to house arrest me. Hence I had to drag them to court and filed a maintenance case against all four of them as I have to clear my flat's EMI."

According to Gaud, his children took his flat's property documents from him and refused to return it to him.
