Mumbai: Dahisar resident moves HC to save 13 trees planted by his grandfather 80 years back

"The youngest member in my family is 7-years-old and I don't want him to not have the trees which we grew up with. The games we played around trees planted by my grandfather, 80 years back, are like family members and we want the Brihanmumbai Municipal Corporation (BMC), to not take away our fond memories," said Chaitanya Pawar, of Dahisar, who has moved the Bombay High Court, challenging an order passed by the Municipal Commissioner, allowing felling of 13 trees on Maratha Colony road.

Pawar said, "My grandfather had built the Pawar house, in Maratha colony, today the 4th generation of my family is living here for the last 100 years. We want to save the trees, for our future generations, who will not move out of the area/house."

The corporation has carried out road widening of the road and wants to hack 13 trees which the Pawar's claims are along the road and not coming in way of traffic movement. The application filed by Pawar reads, "It is the statutory duty of the corporation to preserve, protect and enhance the tree cover in Mumbai. If any tree is genuinely coming in way of traffic, the civic body is empowered to transplant such trees, but not these."

Chaitanya's grandfather Tatoba Jivaji Pawar had constructed the house, and planted the trees, Mango, Neem and other varieties, which are now fully grown up and around 80-years old. Few years back, they redeveloped their property, from a ground floor structure to a ground plus two- floor house and handed over a portion of the property to the corporation for road widening. Pawar said, "At least two trees are still within my property while the rest are adjacent to my plot of land and along-side the road. These trees can surely be protected."

The plea seeks directions to stay the implementation of the Municipal Commissioners order dated January 25, allowing felling of the trees. Appoint an expert committee to examine the trees/area and submit a report.
