Mumbai court annuls marriage after man forces wife to undergo abortion

In a relief to woman, the family court has dissolved her marriage to a man who forced her to undergo abortion and hid the fact that he was already married and had children.

Annulling the marriage Sana and Irfan (names changed), Principal Judge Laxmi Rao directed the man to give meher (money given by husband to wife after marriage) of Rs 1.25 lakh as was mentioned in the nikahnama. The court also Irfan to pay Rs 30,000 for iddat (waiting period before either of the parties can re-marry) period.

Sana was represented by advocate Neelofar Akhtar.

The couple had married in November 2012 as per Islamic tenets. After marriage, Irfan did not take her to his house, alleged Akhtar. When she questioned Irfan on the issue, he allegedly threatened and beat her.

Every fortnight, Irfan would go to Gujarat for three days on the pretext of work. In March 2012, he did not return. He would then visit Mumbai once in a while. When Sana informed Irfan in May 2012 that she was pregnant, he asked her to undergo an abortion.

Soon, Sana learnt that Irfan was married and had two kids. She then decided to walk out of the marriage. But Irfan didn't reply to her legal notice. He also did not respond to the notices sent by the family court. The court then took Sana's testimonies and dissolved the marriage.
