Mumbai constant abuses by wife is cruelty to husband: Family court

A family court has granted a man divorce on the grounds that his wife abused him and his family members and it agreed this amounted to cruelty.

The 36-year-old man stated in his petition that the woman was short-tempered, adamant, whimsical and rude. They moved out of his parents house some time after their marriage in November 2011 due to her quarrelsome nature and again changed house after she demanded a bigger place.

The man also informed the court that that during treatment for menstrual problems, it became known that she suffered from depression. It was then that her maternal uncle revealed that her mother and sister had been undergoing psychiatric treatment.

"The respondent and her family members suppressed the important facts of her illness and trapped him into the said marriage on the basis of false representation and fraud," his advocate said in the petition.

In an attempt to salvage their marriage, the couple met with family members and decided to move out of his parents' place. But after some time the problem erupted again.

They could not celebrate their anniversary or other occasions with friends as the woman would create a scene and they had to leave the venue of the celebration, the petition stated.

The woman appeared just once before the court and did not filed any statement, the court noted.

"Relying on the unchallenged evidence of the petitioner (husband), in my considered view, the petitioner has proved the ground of cruelty as contemplated under section 13(1)(ia) of The Hindu Marriage Act, 1955," principal judge Laxmi Rao stated, while granting divorce.
