Mumbai civil court get stricter action against illegal constructions in South Mumbai

The city civil court has come down heavily against illegal constructions in Mumbai's B ward and C ward — that is Masjid, Dongri, and Pydhonie area. In the two illegal construction cases heard in the court last week, the court vacated the stay for demolishing building number 244 on Narsi Nath Street near Masjid bunder railway station and in another case rejected the stay for building number 30/32 on Masjid street. Both the buildings were re-constructed in the name of repair work, the permission for which was granted by the Maharashtra Housing Area and Development Authority (MHADA).

Speaking to DNA, Uday Shiroorkar, Assistant Municipal Commissioner of B and C ward, said, "The modus operandi of the violators is to seek permission for repairs from MHADA. Then, instead of repairing the building, they completely demolish it and turn it into a high-riser. When the BMC sends them a notice, the violators approach the court and get a stay. It was the same case for building 244 on Narsi Nath street. But now we have demolished it."

DNA had reported on Wednesday about illegal buildings mushrooming overnight without BMC's permission in B and C ward. Recently, J Ghedagmal, ward officer of C ward, and sub-engineer Ravindra Tiwari were suspended for taking no action against a 10-storeyed illegal building on Ismail Curtay Road in Pydhonie.

Tiwari had allegedly served a notice to building 30/32 on Majid street despite MHADA sending ten letters to the ward officer regarding re-construction of the building in the name of repair work.

"We were demolishing building 30/32 on Masjid street on May 3, but the violator approached court to get a stay. However, the court has given its judgment and rejected their appeal. The B and C ward will continue the fight to curb the illegal construction activities," an official said.
