Brihanmumbai Municipal Corporation (BMC) had sent a notice to the owner and occupants of the Kesarbai Building in 2017 to carry out a structural audit which is mandatory for buildings which are older than 30 years. The structural audit report classified the building as 'C1 category', which means the building was supposed to be evacuated for demolition at the earliest.

In August 2017, the civic body informed the Maharashtra Housing and Area Development Authority (Mhada) about the building being categorised as dangerous and ask to do the needful.

As per a letter sent by the BMC to Mhada executive engineer on August 7, 2017, MN Dumani, a resident of the second floor of Kesarbai Building sought information from the BMC about the notice under section 353 B of MMC act and complained about the deteriorating condition of the building.

As per the provision of section 353 B of the MMC Act 1888, it is obligatory on the part of every owner and occupier of buildings which are in existence and are in use for more than 30 years to have them inspected through qualified structural engineer registered with the BMC.

The civic body then sent the notice under 353 B to the owner and occupiers to carry out the structural audit and submit the report. The trust M/s. Bai Hirabai Rahimbhi Aloo Parco and Bai Kesaibai Dharmsay Khakoo Charitable and Religious trust informed the BMC that the audit work was in progress. The audit report from the said trust dated July 31, 2017, said the building is classified as 'C1' (most dangerous condition) and was be evacuated for demolition at the earliest.

The civic body had mentioned in the letter to the Mhada that they learnt that the said building was a Mhada Cess Building and requested Mhada to follow the guidelines as mentioned by the Bombay High Court and take necessary steps to prevent the life of tenants and passersby.
