Moot court at JJ hospital to help doctors handle medico-legal cases better

Taking a serious note of rising cases of medical negligence against doctors, the JJ hospital has decided to step in and help the fraternity avoid legal tangles. In a first, the hospital will hold a programme – Law Medicon – on April 4 to raise awareness of the issue through a moot court.

Taking a serious note of rising cases of medical negligence against doctors, the JJ hospital has decided to step in and help the fraternity avoid legal tangles. In a first, the hospital will hold a programme – Law Medicon – on April 4 to raise awareness of the issue through a moot court.

According to the Maharashtra Medical Council (MMC), it comes across 50 to 60 cases of medical negligence every year. MMC is a statutory body having powers to suspend a doctor's licence if s/he is found guilty of malpractice. Also, complainants in some cases approach the consumer court.

"We want to sensitize the medical fraternity through this conference on how to avoid legal complications, understand in court proceedings, what care should they take while taking consent. There are some senior people in this field who will speak on medical ethics, professional misconduct and medical negligence. We will also touch topics like criminal negligence and role of police in medico-legal cases." said Dr V P Tilwani, assistant professor of department of surgery at JJ.

"Conferences on the issue might be happening in the state, but this is the first time doctors will experience a moot court. This will help them understand court proceedings. Through this session, they will learn about the dos and dont's." said Dr M B Tayde, professor and head of surgery department of the hospital.

Terming the move need of the hour, MMC member Dr Shivkumar Utture said that more and more doctors were getting embroiled in legal complications. "If a patient's relatives suspect misdiagnosis or wrong treatment, they can approach the police or consumer court. In such a case, the doctor should be aware of the laws. Sometimes, a patient may file a case with wrong intentions."

About the conference
The conference will be held on April 4 on JJ hospital campus and will be inaugurated by Justice Dr S Radhakrishnan, former judge of Bombay high court. Dr Arun Jamkar, vice-chancellor of Maharashtra University of Health Sciences, Brijesh Singh, inspector general of police, CID, Laxmi Narayan, joint commissioner of police (crime), Thane, will deliver lectures. The free seminar is open to doctors from St George's hospital, GT, Cama and JJ, but prior registration is must.
