MMRC carrying out Metro work at night despite court stay, say Churchgate residents

Residents are complaining of noise and air pollution, some even asking for compensation

Residents of Churchgate have alleged that construction work of Colaba-Bandra-Seepz Metro-3 underground corridor is being carried out at night by Mumbai Metro Rail Corporation (MMRC) despite a stay from the Bombay High Court which restrains MMRC from carrying out work between 10 pm and 6 am.

Residents have claimed that the noisy construction work in their area disturbs their sleep cycle in odd hours of the night. They say that it is only after the police is contacted and they reach the spot that MMRC stops the work.

The High Court, in August 2017, had directed MMRC not to carry out any construction or ancillary activities of the Metro-3 project at night for a period of two weeks after a resident complained of inconvenience. However, the stay has been extended subsequently.

The direction had come after a petition was filed by lawyer Robin Jaisinghani, a resident of Cuffe Parade, citing inconvenience caused by the late-night construciton activities.

Jamshed Khambatta, a resident of Jamshedji Tata Road in Churchgate, said, "I have been complaining to the control room of police for the past four days every night. Metro-3 construction work continues till 11.30pm every night despite there being a deadline of 10pm. At times, they start work in our pipeline at 4am in the morning causing air as well as noise pollution in my house."

"The MMRC should compensate me and also install an air purifier and sound proof windows in my house. I have developed a problem of bronchitis because of the ongoing work and the dust that has come with it," he added

However, an email query sent to MMRC remained unanswered till we went to the press on Wednesday.

Earlier, MMRC had also installed noise barriers in Cuffe Parade to mitigate noise levels at the construction site. MMRC has been claiming that noise pollution rules cannot be enforced at Metro rail construction sites in Mumbai, which come under the Metro Act, a special enactment that can override the general laws under which such rules are framed.
