Mazgaon Metropolitan Magistrate Court raps family for accusing daughter-in-law of black magic

The Mazgaon Metropolitan Magistrate Court, while passing orders in a case of domestic violence, held that installing a CCTV camera in the room of a person to monitor their movements, amounts to invading their privacy. It held that alleging a person of practicing black magic and not able to prove the same amounts to cruelty and mental harassment.

The court was hearing a case of domestic violence filed by Nazma Shaikh (42) Mumbai Central resident against her in-laws, which was restricting her from living in the house. The court ordered the family to act lawfully and abide by the orders passed against them.

While ordering for the removal of CCTV cameras from Nazma's room, the court said, "The nature of allegations made by the victim about her movements being restricted in the shared household, installing the CCTV camera in the house where she sleeps and the incidents of she being driven out if the house, fall within the ambit of domestic violence. Her right to privacy needs to be protected because fixing CCTV cannot be a solution to the dispute between the parties."

Nazma had approached the court seeking directions against her family who were mentally and physically harassing her. Nazma's complaint reads, "She was never allowed to use any of the basic amenities like the water, electric city, gas, in the house. Rather the accused members, on the instructions of some police officer had installed CCTV in the room where she was sleeping, thus intruding in her privacy. The accused started calling her mad and said that she was involved in performing black magic, which had left her in a disturbed state of mind."

Nazma further said that she was harassed to the extent that between the year 2011-2015, she had filed total 20 non-cognisable (NC's) against the accused members.

On the other hand, the accused denied the allegations but were insisted that Nazma was performing black magic.
