Man seeks ban on Bal Swachhata Mission, Bombay High Court says come 'well prepared'

The Bombay High Court on Friday refused to entertain a public interest litigation, seeking orders to restrain the ongoing Bal Swachhata Mission, and asked the petitioner to come well prepared to the court.

In his PIL, advocate M V Holmagi has opposed the cleanliness drive on the grounds that it is arbitrary and illegal to make children sweep for seven days. The government on November 14 launched the programme at schools across the country to sensitize and involve the children in different aspects of hygiene and safe sanitation.

A division bench of Justice Anoop Mohta and Justice N M Jamdar refused to spend any time on the PIL as Holmagi had not attached a copy of the government circular directing the educational institutes to make their students do the cleaning.

Advocate Holmagi, who has made Prime Minister Narendra Modi as one of the respondents, stated that he and his family members have been a worker of the Indian National Congress party, his father was a freedom fighter. The petition states that if the children are made to sweep then it will affect the child's education.

The petition prayed that the Bharatiya Janata Party, for its personal gains, not be allowed to harass school or college students and use government machinery. Further, orders have also been sought to restrain the BJP from using the names of Mahatma Gandhi, Jawaharlal Nehru or any other leader for its promotion to celebrate the 125th birthday of Late Nehru.

The court though while refusing to show any urgency in hearing the plea said "In Public Interest Litigation, you (Holmagi) should come well prepared." Advocate G W Mattos who appeared for the state and was present in the court, also informed the bench that the first thing that the petitioner needs to do is to serve a copy of the document on the government pleader."
