Man gets divorce from wife for whom he waited 25 years

Court says woman leaving husband for another man is greatest cruelty a spouse can commit

"The fact that the wife has left her husband for another man is the greatest kind of cruelty that a spouse can commit on the other spouse," maintained the family court while granting divorce to a 56-year-old man. The family court upheld the husband's claim that it was his wife who had treated him with a cruelty even after the man was showing her love and affection.

As per the man's petition, they got married in May 1976 in Sangli. He claimed that right from the time they got married, his wife used to be aloof and unhappy all the time. However, he always used to think that since she sat alone at home she must be bored and tired. Thus, on her demand, the man allowed her to start working so that she would not feel aloof or sad.

"However, from the time she started working, she started behaving rudely with the man. In order to keep her happy, he would take her out for shopping and would also do other things which would help lift her mood. But, even then, she used to be the same. The wife instead used to refuse to show her love and affection towards the husband," read the order copy.

Finally, she left the man. The man went to the police and filed a missing person's complaint. The woman later approached the police station and informed that she was fit and fine and that she would henceforth reside with the man whom she loved. She then informed the husband too about her decision.

After waiting for a period of almost 25 years, the man finally lost hope of his wife returning to him. In 2001, he approached the family court and filed a divorce petition against his wife.

The woman, however, contested the claim and maintained that it was not she who had voluntarily left her matrimonial house but it was the man who had forced her to leave. The woman claimed that the man was of a suspicious nature and it was he who had committed cruelty on her by raising doubts on her character.

The court, after going through the evidence, held that the woman had an extramarital affair and thus she had committed utmost cruelty against her husband and granted the man divorce from his wife.
