Malabar Hill residents move court over Priyadarshini Park

The forum has been in a legal battle with the corporation for over a year now.

The High Court on January 28, will hear a petition filed by Malabar Hill Citizens forum, challenging the quit notice, issued to them by Brihanmumbai Municipal Corporation (BMC), directing them to vacate and hand over possession of the 65,000-sqm Priyadarshini Park on Napean Sea Road.

The plea was mentioned before a bench of Justice Ranjit More on Tuesday, which has posted it for further hearing next week. The forum has been in a legal battle with the corporation for over a year now. The civic body under its garden policy wants to maintain the park. Earlier, the forum has also opposed the decision of the corporation to deploy a fire engine inside the park with a view to helping the local residents in case of an emergency.

The civic body has alleged the MHCF used public funds to build a gymnasium, recreation hall and party hall and was using the tennis court as a shop selling cold drinks and snacks without approval from the civic body, which the MHCF has denied.

The plea says the notice issued by the corporation is completely illegal and arbitrary. It prays for quashing and setting aside the notice and continues the possession with the forum.
