The Malabar Hill Citizens’ Forum, which adopted Priyadarshani Park from the Brihanmumbai Municipal Corporation (BMC) in 1987, has approached the Bombay High Court over the electricity bill.
The Brihanmumbai and Electric Supply and Transport (BEST) Undertaking raised a demand notice of more that Rs4 lakh under a category of supply which is not for public use.
The association has challenged BEST’s notice to pay Rs4,26,748 from January 1, 2009, to June 2011, for two electric meters which are used for the sports complex on the plot.
The petition expresses objection to the bill amount.
It states that the two meters are put under the category of LT II (for commercial use) under the electricity bill while it should be under the category LT VI, in which electricity is supplied for street lighting and public parks.
A division bench of Justice VM Kanade and Justice MS Sonaka observed: “The city has very few open spaces. The park is a place where evening walkers go for a stroll and it should be treated differently.”
The forum sought to be put in the LT VI category the two meters which are used to supply electricity to the sports complex and sought to quash the demand notice.
While adjourning the matter to December 23, the court directed the forum to submit the outstanding amount it is supposed to pay.
The court directed BEST to consider it and accordingly decide on their plea.
