MahaRERA action against incorrect Occupation Certificate

In a first, the appellate tribunal of MahaRERA has asked the secretary to take action against an architect for issuing a factually incorrect certificate. While hearing an appeal, the tribunal found that a builder had said in the court that an occupation certificate was issued to a building but the tribunal later found that the lift, staircases and other facilities were not complete.

Meanwhile, the architect, Manoj Dubal, said that he will file his reply to the MahaRERA when a notice is issued to him. The case pertains to a delay in possession by a developer named 'Sea Princess Realty' for a project in Borivali. Some home buyers had originally complained about the delay in possession of apartments and amenities by the developer.

Meanwhile,after the news of MahaRERA requesting action against architect Manoj Dubal, the Architect body PEATA is clearly upset. Former president of PEATA Shirish Sukhadame said, "Firstly RERA is not the body to take action against architects, we have Council of Architects, where every party concerned is heard."
