Maharashtra trust vote: Congress mulls legal action

Terming the Devendra Fadnavis-led BJP government as unconstitutional, Congress state unit president Manikrao Thakare said Congress would meet governor C Vidyasagar Rao on Friday with a request to act against the partisan approach of the speaker resulting in denigrating institutions like the assembly.

Speaking to dna, Thakare said that the governor has given an appointment for the Congress delegation on Friday evening. He said that the delegation of Congress would demand constitutional responsibility of proving the majority on the floor of the House which was not done yet. He said that it is mandatory on BJP to prove its majority since it is a constitutional requirement.

Retaliating to the BJP challenge to the Congress of bringing a no-confidence motion against the government, he said, "Those who can't win majority with 122 MLAs are challenging the Congress for bringing a no-confidence motion and this itself shows that they can't prove majority on the floor of the House."
Meanwhile, Congress Rajya Sabha MP Bhalchandra Mungekar said that since the voice vote procedure also was not completed by the speaker, this government is yet to prove its majority on the floor of the House. He said that the government is unconstitutional and that is the reason Congress would appeal governor Rao to ask BJP government to prove its majority.
Mungekar told media persons that after meeting governor C Vidyasagar Rao, Congress would also explore legal options to challenge the action of the speaker.
Minister for higher, technical education Vinod Tawade said that neither Congress nor Shiv Sena demanded division of votes in time and if they don't know the procedures of the House, how can the speaker be blamed. He said that finance minister Sudhir Mungantiwar has raised a valid point and the government wanted to know as to what action is governor contemplating against the governor-nominated MLCs who shouted slogans against him and blocked his way while entering the state assembly.

Chief Minister Devendra Fadnavis has challenged the opposition and said that the Congress can bring a no-confidence motion if it feels that the government was in minority and he was ready to prove majority any-time on the floor of the House. Speaking to media persons on Wednesday night, Fadnavis said that his government has proved majority on the floor of the House in a legitimate manner. He said that the trust vote was passed by adhering to all the democratic norms and traditions. Meanwhile, senior minister Vinod Tavde pointed out that it was not for the first time that confidence motion was passed with a voice vote.
