Maharashtra not providing evidence to ban Sanatan Sanstha: NIA

The National Investigation Agency (NIA) and Union home department on Monday argued before the Bombay High Court that even after repeated reminders the Maharashtra government has failed to provide any evidence for proceeding on the proposal to ban right wing outfit Sanatan Sanstha.

Counsel for the Union home department and NIA, advocate GR Sharma argued before the court that in May the Union government had sent a reminder to the state home department seeking evidence but till now no response has been received. Previously as well such reminders have been sent but they have not got any response.

The state Anti-Terrorism Squad (ATS) had in 2012, by filing an affidavit, stated that the authority to declare an organization unlawful is with the central government under Section 3 of the Unlawful Activities (Prevention) Act.

Further, it said it would be up to the Centre to independently investigate and assess whether the outfits can be declared as terrorist organisations.

The affidavit had annexed a copy of the proposal marked as "secret" sent by the additional chief secretary of the home department to the director of ministry of home affairs in April 2011, informing that three bomb blast cases have been registered against the Sanstha activists.

The government had concluded that the organisation (Sanatan Sanstha) is liable to be banned with its affiliated sister concerns Hindu Janjagruti Samiti and Dharna Shakti Sena. It has requested the Centre to consider the recommendation and declare the outfits as unlawful and include its name in the UAPA as a terrorist organisation.

Recently, the CBI arrested a doctor from Navi Mumbai for his alleged involvement in the murder of Rationalist Dr Narendra Dabholkar. In another murder case of Dr Govind Pansare the agency arrested accused Sameer Gaikwad, who is also associated with the group.

The statement was made during the hearing of a public interest litigation was filed by Vijay Rokade, seeking to declare Sanathan Sanstha, the right-wing outfit, as a terrorist organisation as it is carrying out activities which would cause destruction of the administrative and legal governance under the constitution of India.
