Maharashtra government must respond to plastic ban petitions: Bombay High Court

Sathe in his arguments said that on March 1, the government has in it's affidavit stated that it had still not finalized the ban.

The Bombay High Court on Monday directed the Maharashtra government to file its affidavit in response to three petitions filed by plastic manufacturers association challenging the recently imposed plastic ban. The court has asked the State to be ready with its reply on April 11.

A division bench of Justices A S Oka and Riyaz Chagla were hearing the matter, when Senior Counsel Milind Sathe, appearing for one of the petitioners, argued that the Maharashtra Plastic Manufacturers Association had approached the High court in February this year when the ban was proposed by the government.

Sathe in his arguments said that on March 1, the government has in it's affidavit stated that it had still not finalized the ban. In the event of planning one , it would first issue a public notice calling for suggestions and objections before imposing it. However, nothing of this sort was done, rather on March 23 directly a notification was issued on the ban.

Meanwhile Advocate Janak Dwarkadas, Counsel for another petitioner in his say that the State cannot put such a blanket ban without proper rules.

On March 23, the state government issued the Maharashtra Plastic and Thermocol Products (Manufacture, Usage, Sale, Transport, Handling and Storage) notification banning plastic.
