Maharashtra government has only 15 days to challenge MAT's 'no reservation' order

If the state government, in the next 15 days, does not challenge the Maharashtra Administrative Tribunal's (MAT) latest order cancelling reservation in government recruitment and promotions, there will be no reservation henceforth in government jobs and promotions for the socially and economically backward class in Maharashtra.

If the state government, in the next 15 days, does not challenge the Maharashtra Administrative Tribunal's (MAT) latest order cancelling reservation in government recruitment and promotions, there will be no reservation henceforth in government jobs and promotions for the socially and economically backward class in Maharashtra.

What does the MAT order say?
Passed on November 28, 2014, the order says there is no need for reservation in government jobs and promotion. It directs the state government that if an appeal against the order is being considered, it must be filed within 90 days from the date of the order.

But as per the Constitution...
As per the Indian constitution, Article 16 (4), every state has the right to implement reservation in recruitment and promotions for the socially and economically backward class. The other backward class (OBC), scheduled tribes (ST) and scheduled castes (SC) have been availing the 52% reservation in recruitment and promotions in Maharashtra since 2004.

What is the opposition saying?
NCP state president Sunil Tatkare said the government's agenda has been exposed, with it not challenging the MAT order. "The socially and economically backward people will be deprived of their right and it will hurt many in government services as they won't get promotion. The Fadnavis government is against the minority and the socially and economically backward people. That's why, despite the green signal by court for Muslim reservation in education, the government did not bring in any such supporting Bill in assembly. Also, the Maratha reservation issue too wasn't properly handled by the government. Now, many people's career is in limbo," Tatkare alleged.
NCP spokesperson Nawab Malik said, "It shows the government's intention, that it is anti-reservation. It is sad and unfortunate that socially and economically backward people's constitutional right will be snatched because of the state government's apathy. We plan to stage a massive protest against the government soon."

What's the govt's version?
Social justice minister Rajkumar Badole said he is not aware about any such MAT order.

Against the order
A few months ago, some government servants had gone to high court over the MAT order. However, the court had directed them to approach the tribunal itself.
