As a relief to nearly 181 home buyers who have been struggling to get their homes for almost a decade, the MahaRERA decision on February 9 directed the developer to complete the stalled projects by 2019.
The home buyers had booked their homes in 2009 in Phases 1 and 2 of the project named Tanvi Eminence at Mira Road. However, a tussle between the various partners of the developer led to the project being stalled. The Maharashtra Real Estate Regulatory Authority (MahaRERA), which has been hearing the case lodged by the home buyers, resolved the matter as one of the partners agreed to finish the construction work and hand over the homes by 2019.
Ramesh Prabhu, who was representing the home buyers in the case said that the unity of the home buyers’ association fuelled the positive outcome in the case.
The home buyers had requested that the developers be directed to pay them interest on the delay as per the provisions of RERA.
The six partnering developers for the project remained absent for the initial hearings of the case which began on November 22 last year. During the course of the hearing, one of the developers, Dahyabhai Sutariya agreed to take over the said project by acquiring the stakes from two other partners. Sutariya also produced the documents which showed that the partners have settled their internal disputes and the project has been handed over to him.
On Friday, it was agreed that Sutariya will handover the possession of the apartments to the complainants before December 31, 2019 with a grace period of three months. If the deadline is not met, Sutariya will be liable to pay the interests on the delay.
