Kin of four 2011 triple bomb blast victims paid compensation, collector tells Bombay high court

The collector of Mumbai informed the Bombay high court on Thursday that kin of the four victims of the July 2011 triple bomb blast case, who had not been paid compensation, were recently handed over cheques for the statutory amount with interest for delayed payment, as directed by the court.

Collector Shaila A filed an affidavit stating that cheques had been sent to the kin of the victims and the government had received the acknowledgment receipts. They had also been paid interest as directed.

A division bench of justices Anoop Mohta and NM Jamdar accepted the affidavit and directed the state to file details of those victims of other blasts/Naxal attacks in the state who were yet to be compensated.

The directive came during the hearing of a PIL filed by Prakash Seth, according to which four people in Thane and Ulhasnagar hadn't received compensation to date. The PIL has sought disbursal of the compensation amount as well as an increase in the amount.

According to Rahul Kadam, the petitioner's advocate, Himmatbhai Gadia, Baburam Das and Bhupatbhai Navadia of Thane, and Lalchand Ahuja of Ulhasnagar hadn't received the compensation. Apart from these four, there are others victims too who hadn't been given the compensation amount, said Kadam.

Kadam said the central government had made necessary amendments to the 'central scheme for assistance to civilian victims/family of victims of terrorist/communal and Naxal violence', and given collector the authority to disburse Rs3 lakh.

Another PIL, by advocate Rajeshwar Panchal, has sought that the families of those killed in bomb blasts be paid just and fair amount. Panchal has demanded that the income of the deceased, social status of the family, and the number of dependents should be taken into consideration while deciding the compensation amount. He has pointed out that the Motor Vehicles Act and the Workmen's Compensation Act had laid down a formula to work out such a compensation.
