Kin of accident victim gets more compensation than was demanded

The Motor Accident Claims Tribunal has directed the Brihanmumbai Electric Supply and Transport (BEST) to pay a compensation of Rs 13,91,000 to the family of a 19-year-old youth who was killed in a road accident in 2010. The youth was knocked down by a BEST bus, which was allegedly driven in a rash and negligent manner.

In its order, the tribunal held that the driver's claim, that the accident was caused due to negligence of the deceased, was ruled out by the Mumbai police. They had already charge sheeted him for the offence. The tribunal after going through the evidence held that the very fact that the driver was charge sheeted for the crime, shows that he was indeed involved in the crime.

Meanwhile, deciding on the quantum of compensation, the tribunal was of the view that the age and the salary of the deceased should be considered, and thus the victim's family was granted a higher compensation amount than the family's demand of Rs 4 lakh.

According to the plea for compensation, Bilal Zulfikaar Khan, a youth from Uttar Pradesh who had come to Mumbai to earn a living, was walking with a relative in Govandi on January 1, 2010, when a BEST bus knocked him down. The youth was declared dead on the spot.

In its reply, BEST said that the fault was of the pedestrian too, as he was the one who came in the way of the bus, and thus was equally responsible. The driver also claimed that a departmental inquiry allowed him to walk free.

ROAD MISHAP KILLS YOUTH

  • Bilal Zulfikaar Khan, a youth from Uttar Pradesh who had come to Mumbai to earn a living, was walking with a relative in Govandi on January 1, 2010, when a BEST bus knocked him down. He was declared dead on the spot.
