Kala Ghoda festival can go ahead if certain norms are followed: Bombay High Court to organisers

The Bombay High Court on Wednesday allowed the Kala Ghoda Association to hold the art festival scheduled in February, provided they follow certain conditions with regards to hygiene and noise.

How did the association convince the court?
A division bench of justices VM Kanade and Revati Mohite Dhere allowed the festival after taking into consideration the site map submitted by the association giving details of the stalls and where they would be set up. The court said the plan offered easy accessibility to emergency vehicles.
Earlier, the organisers had also told the court that they are willing to reduce the number of stalls put up during the festival from 89 to 50 on the K Dubash Marg, and the Chhatrapati Shivaji Maharaj Vastu Sangralay has agreed to offer space on its lawns for stalls.

What directions has HC issued?
The court directed the organisers to ensure proper care is taken to ensure there are no live wires on the roads. They have also been told to put up sufficient number of mobile toilets for the patrons, besides appointing a separate housekeeping team to ensure there is proper collection of garbage.
The Brihanmumbai Municipal Corporation has also been directed to collect garbage every two hours to ensure locals are not inconvenienced.
Organisers will also have to ensure that each stall has fire extinguishers, taken either on rent, purchased or borrowed from the Fire Brigade.

Who will monitor the festival?
The court was informed that as per a notification of the government a committee under the chairmanship of the collector will monitor the festival.

What PIL has the court been hearing?
The directions were given during the hearing of a PIL filed by local resident Berges Malu complaining about the nuisance and safety risks faced by those living in the vicinity during the festival.
