Judge's FB activity leads to conflict of interest complaint

A complaint by Powai-resident Kishore Keswani to the Bombay HC registrar general, registrar inspection and the principal judge of the city civil court, has raised serious questions about a sitting sessions judge (Court no. 15)Ahmed Sayeed's granting bail to one Shankar Rohra accused of fraud against the Bombay HC. On both the ocassions Rohra's bail application came up for hearing the facebook (fb) friend Mukesh Kamra, a business partner and close friend of Rohra, was present in court.
While confirming that the complaint was received, the registrar General of the Bombay HC Mangesh Patil told dna, “The complaint was received late yesterday. Like in the case of all such complaints, this will be enquired into before any course of action.”

The complaint, which raises questions on judicial propriety and accountability, citing "conflict of interest," pertains to an FIR (a copy of which is with dna) lodged in the Azad Maidan police station against notorious international bookie Anil Jaisinghani (on-the-run from both the Enforcement Directorate and the police from May 2015), under non-bailable offences of cheating, forgery of government documents and use of the forged documents in his petition to Justice Revati Mohite of Bombay HC while seeking transit bail which he got.

Kishore Keswani who is battling a case in the Gujarat HC against Jaisinghani, then complained to the Azad Maidan police about the fraud and an FIR was lodged (on April 22, 2016) against both the bookie and his associate Shankar Hashmatrai Rohra who had arranged for the fraudulent hospital papers to help him get bail. Subsequently, Rohra applied for anticipatory bail in the additional sessions judge Ahmed Sayeed's court (ABA 995/16).

The complaint says, "When the application for anticipatory bail came up for hearing for the first time on 6/6/2016 and thereafter on 13/6/2016, on both the occasions one Mukesh Kamra, resident of Ulhasnagar who is close friends of Shankar Rohra and Anil Jaisinghani was present in the sessions court."

The complainant Keswani told dna, that Mukesh Kamra had a long discussion with him on June 13, 2016 when he was boasting of having helped Rohra make bail. “I was completely taken aback when he mentioned that the judge Ahmed Sayeed was his friend. He even showed me his name on the judge's facebook friend list on his mobile phone.” Keswani says Kamra brushed off his suggestions about how dangerous this could be by pointing out that he had locked the settings on his own facebook account so that nobody could access his friend list.


 


Keswani's complaint also points out clearly how Shankar Rohra's facebook friend list shows Mukesh Kamra as his friend. "Apart from Anil Jaisinghani's son and daughter Akshaan and Aniksha, Mukesh Kamra's son Rahul are also among Rohra's friends. This joins the dots," he told dna. “The judiciary is the last bastion of hope for the common man. Instances of court cases being reduced to 'fixed matches' like this will erode trust in courts and open doors to a complete breakdown and anarchy. That is why I decided to move the court registrar about what is clearly the illegal use of one friend to help another.”
