JJ Hospital dean held guilty of contempt of court

The order was passed on a complaint filed by social activist Anjali Damania. The court, presided over by judge PR Bhavke, maintained that Lahane was found guilty of contempt of court. A reference will now be made to the Bombay High Court for further action.

The special Enforcement Directorate (ED) court on Friday issued a contempt notice against TP Lahane, the dean of the state-run JJ Hospital, for failing to abide by orders passed by the court in connection with NCP leader and former Deputy Chief Minister Chhagan Bhujbal's stay in Bombay Hospital for around a month. Bhujbal is an arrested accused in a money laundering case.

The order was passed on a complaint filed by social activist Anjali Damania. The court, presided over by judge PR Bhavke, maintained that Lahane was found guilty of contempt of court. A reference will now be made to the Bombay High Court for further action.

The court, on October 27, 2016, had passed an order allowing Bhujbal to visit JJ Hospital to undergo electrophysiology evaluation. The order also said that a machine was to be brought from KEM hospital to JJ Hospital for the holster examination. Also, the order said JJ Hospital should refer Bhujbal to a private hospital for a thallium scan.

After his visit, Bhujbal went to Bombay Hospital to undergo tests, but stayed back for about a month, during which he allegedly had politicians and relatives visit him on a daily basis.

Damania, who had applied to be an intervener in the case, had complained about the alleged illegality and misuse by Bhujbal of the order passed by the court.

The court was of the view that it was Lahane's duty to send the accused back to jail once he was discharged, as opposed to sending him to a private hospital without a court order.

The court was also of the view that the superintendent of Arthur Road jail was not at fault as he had inquired about Bhujbal's whereabouts with Lahane.

Bhujbal is being investigated by the Enforcement Directorate (ED) in a number of money laundering cases.

He was arrested in the Maharashtra Sadan (Delhi) construction scam as well as the Kalina land grabbing case. The agency had conducted multiple searches in connection with its probe against Bhujbal and others.
