Bombay High Court on Tuesday asked Brihanmumbai Municipal Corporation to file an affidavit by October 9, explaining whether it has no other space except Priyadarshani Park in Malabar to set up a fire station.

A division bench of Chief Justice Manjula Chellur and Justice NM Jamdar has asked the corporation to clarify its stand on the availability of 10 sq. m. of land. This followed after the Malabar Residents Association filed a rejoinder to the BMC affidavit saying that the corporation could shift the fire tenders parked inside the park to an adjoining plot which is empty. Further, there cannot be any construction in the park as it falls under CRZ-I zone.

However, the counsel for state government said that the adjoining plot belongs to Maharashtra State Road Development Corporation and cannot be handed over to the civic body. Further, it said that the fire engine is coming in the way of walkers and joggers.

The bench, while asking the corporation to file its reply, observed that at night, double parking of vehicles is prevalent in Malabar Hill area, making most roads narrow, and that the corporation is not doing anything to resolve the issue.

Malabar Hill Citizens' Forum (MHCF) has challenged the Corporations' decision to set up a fire brigade station inside the park. The MHCF had moved the court claiming that several trees and the entrance to the park were demolished to make way for the fire tender vehicles. The petitioner added that the park gates have to be now kept open all through the night so that the fire trucks can go in case of emergencies. This has resulted in several unruly people making the park their shelter at night, sleeping on its benches.
