Horse trainer Dallas Todywalla files anticipatory bail application in rape case

The situation in the court turned ugly as Toddywalla's lawyer questioned the character of the complainant.

Dallas Todywalla, a South Mumbai-based horse trainer on Saturday approached the Sessions court to seek anticipatory bail in a rape case filed against him by his maid after their alleged 24-year-old relationship turned sour. 

The situation in the court turned ugly as Toddywalla's lawyer questioned the character of the complainant. The prosecution will be filing its reply on Monday and the orders will be passed accoridngly.

The complainant's case goes back to the year 1991 when she had come from Ratnagiri to Mumbai to earn a living. She was introduced as a maid to the Todywalla family. The complainant while speaking to DNA, alleged, "I was very naive then. I did not even know how to cook and it was then that I started working as a maid. It was since then that Dallas used to sexually assault me. I was afraid of the consequences that I would have faced if I had raised my voice against the assault.

"Meanwhile, on the assurances of marriage, he continued raping me. Some time 1994, he approached me at night and put a necklace around my neck and also applied sindoor (vermilion) as a token of our marriage. I then thought that he made me his wife, but I was again cheated. It was when he forced me to abort my foetus when I realised that I had been cheated again."

The complainant further alleged that she decided to get married to escape from the situation. "Baba (Dallas) spoke to the man whom I was about to marry and it didn't work," she said.

The complainant also alleged that she was forced to undergo an abortion on three occasions. "In 2016, when I was pregnant for the fourth time, I was again forced to abort. However, when I refused, I was thrown out of the house. Unfortunately, that time I could not save the child as I was suffering from typhoid, which lead to a miscarriage," she said.

Her allegations were rejected by Todywalla's advocate. The defense claimed that the woman was trying to extort wealthy men. "I accept that my client was into a physical relationship with the lady in the year 2016. But the fact that she admitted on her personal chat with the accused that she loved him, shows that the situation does not amount to rape. It is just a way to target the wealthy and get money," argued advocate Abad Ponda.

The court asked the prosecution to file its reply. The prosecution would be arguing on Monday after having asked for time from the court.
