HDIL, SRA connived to gobble up eight acres of prime Chakala property: Developer

A city-based developer has alleged that the Housing Development and Infrastructure Limited (HDIL) connived with the Slum Rehabilitation Authority (SRA) to gobble up 25,271 sqmt or eight acres of prime property in Chakala, Andheri (E). Conservatively, the cost of this plot is over Rs1,500 crore.

According to the documents in possession of dna, Arjundas Thakur and his family originally owned this plot. Then KK Motwani (78) bought it in 2004 at the rate of Rs3.95 crore. To safeguard the plot, Motwani established his office-cum-bungalow there and also erected a boundary wall.

Then, Thakur sold some portion of the plot to Car Bazaar, which led to a dispute between Motwani and Thakur family. Motwani moved High Court, which passed the order that "no third party right should be created on this same plot till the final order of the court". Motwani alleged that despite the court stricture, HDIL bought the disputed plot from Thakur.

Motwani's FIR dated December 5, 2013, whose copy is with dna, stated, "This land was in my possession from 2004-2011. I even published a public notice in newspaper, warning that no sale and any sort of agreement should be made pertaining this plot situated in village Mulgaon of Chakala, Andheri Kurla Road. The Thakur family sold 21.25 per cent stake of the plot to HDIL."

Motwani alleged that even though he owned the land, SRA gave the Letter of Intent (LOI) to HDIL. "We lodged complaints under sections 406 (criminal breach of trust), 420 (cheating), 34 (criminal act done by several persons) and 120B (criminal conspiracy) of the Indian Penal Code against Rajiv Kishanchand Thakur and the directors of HDIL in the MIDC police station. Nothing concrete, however, was done. I even wrote several letters to SRA, demanding action against HDIL, but to no avail," said Motwani.

SRA chief Asim Gupta, however, said the matter was sub-judice so, "we will wait for the final court order." Interestingly, HDIL had also published a public notice regarding the plot, saying they were making inquiries about all the stakeholders. "After reading the notice, our advocate contacted HDIL and informed in writing that the said plot belonged to our firm. They told us that officials will come to our office and examine the documents. The meeting, however, never took place," added Motwani.

Moreover, Ashok Gupta, who signed the deeds documents with the Thakur family, was not given the power of attorney by HDIL. "Thus, all transactions pertaining this plot are all illegal. The work at this plot should be stopped because HDIL submitted the bogus, fraudulent and fabricated documents. I have been fighting this case for the last 15 years," rued Motwani.

Meanwhile, HDIL spokesperson said, "The allegations are baseless and false. They are mere tactics to extort money. We have received necessary approvals from the court and SRA, and a project is under construction at present. There is no restriction by any authority on the development of the said property."
