HC turns down sex scam convict's bail plea for bariatric surgery, again

For the second time, the Bombay high court refused bail to a convict in the infamous 2005 Ahmednagar sex scandal case, Atmaram Dengle, who had sought bail to undergo bariatric surgery.

Dengle had written to the high court from Yerawada prison, seeking bail so that he could undergo the surgery in a private hospital in Mumbai or Pune.

Dengle is obese and suffers from asthma, high blood pressure, diabetes and blood clotting. The chief medical officer of the Yerawada prison had informed him that bariatric surgery is not performed in state-run hospitals and he will need to approach a private hospital. Following this, he prayed for a temporary bail of 90 days.

The last time Dengle made the same request, the court had ruled: “We do not think the petitioner can be advised any course of action by the court as we do not possess any expertise in the medical field. Let the petitioner approach the prison authorities who can, thereafter, refer him to chief medical officer at the prison hospital or other experts if he is not satisfied.”

Dissatisfied with the order, Dengle sought bail for a second time. This time, the Yerawada prison authorities informed the court that “Dengle is facing trial before the additional sessions judge, Ahmednagar, which is within the jurisdiction of the Aurangabad bench of the high court. Hence, this application should be forwarded to the Aurangabad bench.” Hence, the court refused to grant Dengle any relief.

Dengle was arrested on April 21, 2006. He was convicted on August 20, 2010, and sentenced to life imprisonment. Through an appeal, however, he had his sentence reduced to eight years.

Fat to fit? No chance
