HC stops Mhada from giving out 6 acres of Bandra reclamation plot

The plot is in the ownership of MHADA after it was reclaimed from the sea

In a temporary victory for 26 societies situated at Bandra reclamation area, the Bombay High Court on Friday restrained MHADA from letting out a six acre plot, situated opposite Lilavati hospital, for any personal or religious purposes other than being used as playground.

A division bench of Justice Abhay Oka and Justice Vibha Kankanwadi said, “Prima facie open space marked in the Development Control rules, as playgrounds cannot be let out for any other purpose.”

The plot is in the ownership of MHADA after it was reclaimed from the sea. The petitioners General AK Vaidya Rahiwashi Sangh has moved the court seeking that an open space marked should be conveyed to the nearby federation of societies. Advocate SR Nargolkar appearing for the sangh said, “Our main prayer is to seek conveyance of the plot to the societies so that the upliftment of the plot can be done.”

To decide on the issue, the court has now posted the matter for final hearing which will come up in due course.
