The Bombay High Court on Thursday restrained the Suburban Collector from considering a proposal forwarded by Mumbai Metropolitan Regional Development Authority (MMRDA) to allot 40 acres of land to Airport Authority of India at Gorai.

A division bench of Chief Justice Manjulla Chellur and Justice NM Jamdar asked the collector to not allot the land as it is reserved for National Law University. It asked authorities to provide police protection for carrying out survey and demarcation on the land for the University.

Senior Counsel Milind Sathe informed the court that the collector has written a letter to the Vice Chancellor of the University informing that a proposal has been received to allot 40 acres of land out of the 60 acres reserved for the University. This, he said, would yet again delay setting up of a permanent place for the institution, presently operating from a rented premise in Powai.

The bench also took serious note of the issue and said, "We have seen the quality of pass outs from the Bengaluru NLU and we hope the same will be replicated in Mumbai and so the city needs a University."

The direction was given during the hearing of a Public Interest litigation filed by Advocate Pradeep Havnur, in which he states that even when the MNLU Act was implemented in 2014, no steps were taken to allot the 60-acre land in Gorai as promised. Moreover, in the first year of the college, many bright students took admission in the institute, but later dropped out as no proper infrastructure was available.

The University was to be set up in Mumbai, Nagpur, and Aurangabad. However, no efforts or steps are being taken for setting up a permanent campus for the University in Mumbai.

The petition pleaded that the court directs the government to place all records with them with respect to establishing Maharashtra National Law University and upon perusing the records direct them to ensure that the Act is implemented.
