The Central Bureau of Investigation (CBI) has been asked by the Bombay High Court, to request the Interpol to issue a red corner notice and an International Arrest Warrant against a London resident who failed to give his estranged wife custody of their minor son, as per the direction of a family court order passed in 2015.

Justice Rajesh Ketkar has also asked the Interpol to issue a yellow corner notice to ensure that the child is brought back to Mumbai and produced before the court by next month.

The direction was given during the hearing of a contempt petition filed by the woman. The couple got married in February 2010 and in 2014, the woman had moved the family court, seeking divorce on various grounds. In August 2015, the court allowed her divorce and granted the woman custody of her son and directed the husband to pay her a monthly maintenance of Rs 20,000 from October 2014.

However, he did not comply with the court order, making the woman file a contempt petition at the high court. During a previous hearing, the court had asked the husband to clear his stand but he did not respond. It also suggested that he send the child to India, accompanied by a relative. However, he failed to respond to this request.

The court added that the man was given another opportunity to acquit himself of the contempt charge by bringing the child to India during his holidays — between April 3 and April 17— but he failed to do so too. He did not pay for his wife's maintenance either.
