HC gives BMC last chance to decide on study leave of sweeper pursuing PhD

The Bombay High Court has, by way of a last chance, given two weeks time to the Brihanmumbai Municipal Corporation to decide on the study leave sought by Sunil Yadav, a sweeper working with the civic body who wants to pursue PhD degree.

A division bench of Justice S C Dharmadhikari and Justice B P Colabawala said, "You (BMC) cannot keep delaying taking decision on the study leave application. Whatever it is, whether to accept or deny has to be taken for the petitioner to pursue his remedies."

Advocate H C Pimple, appearing for the civic body, informed the court that Yadav's application was under consideration before the Deputy Municipal Commissioner of the concerned department, and the decision taken could be presented before the court on the next date of hearing, for which he sought two weeks time.

Senior Advocate Mihir Desai, appearing for Yadav, argued that registration to the doctorate course had been obtained by Yadav, and the process of selecting a guide was pending. Yadav, recently secured an MPhil degree from Tata Institute of Social Sciences (TISS) and wants to pursue doctorate in the subject of life of manual scavenging, which is still prevalent in the state.

As per service rules, an employee can avail two years of study leave in their career with the corporation. To pursue his MPhil degree, Yadav had taken around three to four months leave, and he has sought leave for the remaining period of around one and half years.

Yadav, had secured seventh rank in his post master's degree with 'Globalisation and Labour'. Now settled in Chembur, he has completed his SSC and HSC, completed his BCom and followed it up with a bachelor's degree in journalism and masters in social work simultaneously in 2011.

It was when he was completing his SSC that he had to take up the corporation job on compassionate grounds as his father was declared unfit to work.
