HC asks traffic cop alleging corruption to convert his plea into PIL so it can frame guidelines

The Bombay High Court has asked serving policeman Sunil Toke, who was previously with the Mumbai traffic department and alleged large-scale corruption, to convert his petition seeking registration of offence against corrupt policemen into a public interest litigation, so that court is able to frame guidelines to tackle the issue.

A division bench of Justice Ranjit More and Justice Anuja Prabhudessai said, “The department should consider coming out with a helpline where citizens can complaint of policemen taking bribe.” However, they immediately added that in the present petition the larger issue cannot be gone into and it should be converted into a PIL, so that guidelines can be framed.

Advocate Pradeep Havnur appearing for Toke agreed to the suggestion made by it, following which the court granted him liberty to amend the petition and directed the registry to place it before the appropriate bench.

Earlier, the anti corruption bureau informed the court that in the investigations carried out by them on allegation of wide-scale corruption practiced in the traffic department, they found no substance.

Toke, who was previously with the Mumbai traffic department has leveled serious allegations of corruption in the department. He provided CDs and audio recordings of the alleged corruption. Even a rate card was provided of how much money is accepted.

The petition sought directions from the court to register a First Information report (FIR) against the alleged corrupt policemen named in his complaints and direct the Director General of Police, Police Commissioner and Joint Commissioner (Traffic) for initiating departmental inquiry against the alleged corrupt policemen.

Toke claims in his plea that under every traffic police division there are two havaldars who are called ‘cashiers’. They go on collecting bribes from car selling showroom, pizza outlets, restaurants, malls and other allied business establishments. The petition gives amount of alleged hafta being collected by the policemen.

It is also alleged that during drunken driving cases, the police team are given a target of registering 5 to 10 cases. However, the concerned team catches 40 to 50 persons who can be prosecuted for drunken driving. The accused who are financially sound are allowed to go home without prosecuting them and only 5 to 10 cases are officially shown.
