The Bombay High Court asked BEST on Thursday whether it can start the non-ac buses on routes where it has now stopped plying AC buses, mainly between Oshiwara and Backbay Depot in Mumbai and between Thane and Mumbai.

A division bench of Chief Justice Manjula Chellur and Justice N M Jamdar said, "AC buses should not have been discontinued in summer season."

Best argued before the court that it decided to stop the ac bus service because the undertaking is making huge losses. The court then asked whether the loss was due to running of two Ac buses. The Best counsel sought time till June 19, to file a detailed reply. The court granted the same and directed BEST to give details of buses that operate between Oshiwara and Colaba and Thane and Mumbai.

The direction was given during the hearing of a petition filed by a senior citizen from Oshiwara, B B Shetty, seeking directions to BEST to re-start AC bus service in the city.

Advocate V P Patil appearing for the petitioner said that due to stopping of buses, people are using private vehicles, thus adding to the traffic congestion. As per the petition, the bus services have been abruptly stopped without any prior notice to the public at large. Further, the sudden stoppage of the services has caused several hardships to senior citizens, women who were regular users of the services, the petition contends.

Navi Mumbai Municipal Corporation continues to ply their AC buses, and only in Mumbai which is called the financial capital of the country, citizens are being denied a comfortable journey, the petition states.
