Thane’s additional district consumer forum has ordered a Navi Mumbai-based developer to hand over flat to a complainant, who had booked it in 2010. The forum also asked the firm to pay a compensation of Rs50,000 for the mental agony.
According to the order copy, Balaji Shinare, had booked a flat in a building raised by M/s Suraj Enterprises, in 2010, for over Rs15 lakh. The complainant, said he had regularly paid his dues to the firm. Till April 17, 2011, he had paid Rs10 lakh. In July 2011, when Shinare approach the firm asking for registration of the property, the firm used to delay the process by giving some excuse.
In 2011, when the firm started demanding more money the complainant realised that the firm did not intend to hand over the flat. The complainant approached his advocate and issued a legal notice, which the firm failed to respond. Then the complainant approached the forum.
After going through the evidence, the forum found that the firm had failed to hand over the flat to Shinare, thus failing to deliver the appropriate services to its consumer.
