Girl injured in accident wins compensation

The Motor Accident Claims Tribunal has granted compensation to a 22-year-old woman in a 2009 case. According to the complainant, she was walking on the footpath on September 9, 2009, when a rashly driven taxi rammed into a jeep stationed near Venin Grand Chowk, which in turn injured the girl. The victim was initially admitted to KEM Hospital, and was later shifted to JJ Hospital for treatment.

The tribunal, however, refused to accept that the victim suffered a fracture due to the incident, but held that she was subject to a degloving injury. Therefore, the tribunal held that a compensation of Rs 50,000 be granted to the woman for the mental and physical pain caused to her. The tribunal awarded a total compensation of Rs 1,85,200 to the victim, who lost her job at the State Bank of Hyderabad due to the incident.

The tribunal directed the insurance firm to file its reply. The firm on their part claimed that the entire fault rests on the taxi driver as he was the one who rammed into the parked jeep.

The tribunal also held, "It appears that the taxi driver was negligent. However, the driver of the jeep should have exercised control to avoid ramming into a pedestrian. The driver of the jeep could have appeared before the court to explain that he had taken precaution to avoid the accident, and was not negligent, but he did not".
