German bakery blast: NIA won't get CCTV footage for now

The Bombay high court on Monday refused to pass an order directing Maharashtra Anti Terrorism Squad (ATS) to provide a copy of the CCTV footage of the 2010 German Bakery blast in Pune to National Investigation Agency (NIA).

A division bench of the court was hearing an application filed by NIA seeking that ATS be asked to provide them a copy of the footage from inside the bakery.

The judges refused to pass the order on Monday, saying they would consider NIA’s application while hearing appeals in the matter. The court will start a final hearing from August 8 for conformation of death sentence to lone convict Himayat Mirza Baig and his appeal against conviction.

On February 13, 2010 a bomb exploded inside the bakery, killing 17 people and injuring 58.

The NIA, which which took over the blast case at a later stage, sought a copy of the footage to ascertain the identity of the person who planted the bomb inside the bakery. It said that footage obtained by ATS shows the bomb being planted by Yasin Bhatkal, alleged founder of terror outfit Indian Mujahideen.

The NIA told the court that the footage would provide clues to the planter and to identify people who had seen this person who planted the bomb.

On April 19, the sessions court in Pune awarded death penalty to Baig, a resident of Beed.

According to the law, the state government has to get the death sentence confirmed from the Bombay high court.

Baig was convicted under various sections of the Indian Penal Code, the Explosive Substances Act, and the Unlawful Activities Prevention Act, 1967.

According to a charge sheet filed by ATS, five accused — Fayyaz Kagzi, Yasin Bhatkal, Iqbal Bhatkal, Riyaz Bhatkal and Mohsin Chaudhari – are absconding.
