FIR against SBUT alleges lack of eviction efforts

Evacuation efforts weren't made for two shops in the ill-fated building

The JJ Marg police in its FIR and statement of complainant against the office bearers of Saifee Burhani Upliftment Trust (SBUT) has alleged that the trust did not take any solid efforts to evacuate the kitchen of a sweet shop and another kitchen, Bhatiyarkhana, that was functional on the ground floor of Hussaini building which collapsed on August 31, killing 33 persons and injuring 16 others.

According to the FIR and statement of the complainant which is in DNA's possession, it specially mentions the two aforementioned kitchens. The statement notes that many workers would stay at the said premises but the trust made no effort to evacuate or ever asked the police for support to remove them. All this despite knowing that the building is dangerous. The statement further alleges that the trust's office bearers never asked for the police's help in evacuating the building's residents, or the workers from the ground floor, nor did they serve the workers a notice for vacating the building, which indicates negligence on the part of the trust's office bearers.

When contacted, a spokesperson for SBUT said, "Since an investigation is being conducted by concerned authorities, we are unable to comment on this matter at the moment."

On May 27, 2016, the trust received a notice from Maharashtra Housing and Area Development Authority (MHADA) stating that the building was in a dilapidated condition and unsuitable for living hence it should be vacated and demolished. The statement points out that it was necessary that they should have vacated the houses for redevelopment.

NEGLIGENCE?

  • A case was registered against unidentified office bearers of SBUT for culpable homicide not amounting to murder on September 13.
     
  • On May 27, 2016, SBUT received a notice from MHADA stating the building was in a dilapidated condition
