FIR against cops in 2013 bar raid

In an embarrassment to the Mumbai police department the Wadala police have recently registered a criminal complaint against an assistant inspector and staff of special squad of south region police for allegedly assaulting staffers of a bar in Wadala and also allegedly pocketing money and showing a wrong amount in panchnama.

In an embarrassment to the Mumbai police department the Wadala police have recently registered a criminal complaint against an assistant inspector and staff of special squad of south region police for allegedly assaulting staffers of a bar in Wadala and also allegedly pocketing money and showing a wrong amount in panchnama.

According to the police sources, a special squad of south region police had conducted a raid on Panchvati Bar and Restaurant in Wadala area on December 23, 2013. The hotel staffers had levelled allegations against the squad after which a preliminary enquiry was conducted by assistant commissioner of police, Dongri division, Sanjay Diwadkar.

"After the completion of preliminary enquiry, on February 2 an FIR has been registered against the squad members, including an assistant police inspector attached with JJ Marg police station," confirmed Mumbai police' spokesperson and deputy commissioner of police, Dhananjay Kulkarni.

As per the allegations of the hotel staff, during the raid policemen from the squad had misused their powers. The policemen abused hotel staffers, forcibly took money from customers and a female waitress and hit them on the palm with bamboo stick," said an officer from Wadala police station.

The staffers had further alleged that Rs 1.35 lakh were there in the cash counter of the hotel, but the squad members only showed panchnama of Rs 33,885 and pocketed the remaining amount.

The squad members have been booked under sections 380 (theft), 384 (extortion), 323 (voluntarily causing hurt), 506 (criminal intimidation) and 34 (common intention) of the Indian Penal Code.

"You meet me personally to discuss on the matter," Diwadkar told this correspondent when called.

"Special squads are doubled edged weapons. Special squad is required to keep a check on corrupt activities of local cops but many times they themselves becomes extortionists. When special squad raid then action should be taken against the local police station staff for permitting illegal dens to flourish. Squad does the raid, but the second part of the action to suspend local officers for connivance does not takes place in most cases and hence the purpose of special squad is getting defecate. The FIR in Wadala case is a good step that has been taken and it will improve the image of the police department and would encourage others to speak against the police atrocity," said former Indian Police Service officer and lawyer YP Singh.
