Family court rejects divorce plea of wife who alleged cruelty

A family court recently saved the marriage of a Mumbai-based couple. The court accepted the petition filed by the husband for saving the marriage, as his wife failed to prove that she was a victim of cruelty at the hands of her husband.

The woman had initially approached the family court seeking a divorce on the grounds that she was a victim of dowry demands. In her application, the woman claimed that her in-laws forcibly removed her 'Stree-Dhan' (gold) jewellery and retained other articles without her consent.

She also claimed that she was subjected to cruelty four months after her marriage. Thus, she had approached the police and had filed a domestic violence case against her in-laws.

However, the husband opposed the petition, and instead filed a petition for restitution of his conjugal rights (right to stay together). He alleged that despite his wife having an unhygienic habit of chewing tobacco powder and gutkha, he tried adjusting with her. However, she still left her matrimonial house with her daughter and even took her Stree-Dhan along.

However, when the court asked the wife to cross-examine the husband on his petition, she failed to do so. Thus, the court accepted the application filed by the husband and directed the woman to stay at her matrimonial house along with the couple's four-year-old daughter.
