According to legal experts, the case of Dilip Shirke (55), who shot dead his senior and later killed himself, is a closed case. They also claim that the family of the accused will receive all the benefits which it is entitled to.
Senior counsel and special public prosecutor Francis Saldanha said that there is no way the department can stall the monetary benefits a policeman is entitled to after his death. There will be no curb on the provident fund money, since it is something which is dealt at the government's end. Also, since the accused police officer had already completed 15 years in service, his family is entitled to the gratuity too," said Saldanha.
When questioned if the Shirke family would have to vacate the government quarters, Saldanha said: "The moment a policeman is no more on duty, he needs to vacate the quarters. In this case too the family will have to arrange for some other accommodation."
Saldanha added that at the initial phase a case of murder will be registered against the deceased police officer, but later it will be dropped, since the accused is dead.
When dna contacted retired IPS officer and law expert YP Singh, he said, "If the accused was alive, then a departmental inquiry would have been initiated against him. But now there is no use of an inquiry since nothing against him can be proved. There will be no restriction on monetary benefits which the family of the accused is entitled to."
