Ex-worker drags bank to Bombay High Court for illegal sacking

The petition states that due to the illegal and discriminatory decision of his dismissal, he has suffered mental agony, loss of reputation, stigma on his career and professional life, since April 2016.

A former Country Executive (India) of Royal Bank of Scotland, who was sacked last year on charges of sending inappropriate WhatsApp messages and videos, to a colleague at work, has dragged the bank to court seeking monetary benefits, which he could have otherwise availed if not sacked.

The suit filed in the Bombay High Court, by Jai Jingar through his advocate Rajesh Vanzara, denied all charges of sexual harassment leveled against him, and claims the internal inquiry committee set up by the bank to probe the charges was not correct in its decision.

The petition states that due to the illegal and discriminatory decision of his dismissal, he has suffered mental agony, loss of reputation, stigma on his career and professional life, since April 2016. 

Jingar claimed that he be paid a salary, bonus, gratuity and provident fund for the remaining period of the contract up to 60 years until the age of retirement. Since the bank issued public notice to cease operations in India, as per the norms of RBI, like all employees, he is also entitled to a retrenchment package. The suit prays for orders to declare the decision of dismissal as illegal and that it be cancelled.
