A day after unaided schools raised objection over the education department's demand to give students admission in both pre-primary and Std I under the RTE Act, the department has claimed that there is nothing illegal about this. Department officials said there were schools that did not fill the seats kept aside for RTE admissions in 2012-13 and, hence, this year those seats have been carried forward to Std I. Therefore, they must take admission for both pre-primary and Std I, they added.

The Unaided Schools Forum had sent circulars to unaided schools to deny students admission in Std I under RTE if they have already taken in children in pre-primary section under the Act.

So far, the department has confirmed admission of 560 students under RTE. The process has been extended till April 17. The civic body will conduct the second lottery on April 20 and the last day of admissions will be April 27.

Deputy director of school education BD Phadtare said, "There is nothing illegal or wrong in what we are asking schools to do. The primary education department in Pune has set the website in such a way that schools that had vacant seats in their pre-primary section in 2012-13 will have to fill the same in Std I this year. Hence, those schools are getting applications for admission in pre-primary, which could be their entry level, as well as Std I."

"The schools concerned should give admission in both as the government is paying for these students," said a senior department official.

However, forum secretary SC Kedia slammed the reasoning and said, "The department will say anything. The schools are bearing losses as the money government is giving per child is less compared to the expenses incurred in unaided schools. We have decided to file a writ petition."
