Drunk cop suspended for raising a ruckus in Worli police station

A traffic police constable was recently suspended for creating a ruckus in Worli police station while under the influence of alcohol and arguing with the officers stationed there. The constable, Nilesh Shinde, who is posted with Vakola traffic division, and lives in Worli, picked a quarrel with the Worli police who had taken action in Shinde's neighbourhood against the use of a loudspeaker beyond the permitted time limit. Shinde trotted to the station, started shouting, and demanded that the police release a few persons whom they had brought to the station in order to fine them. He then threw his weight around, claiming he had worked with superior officers.

“Shinde also misbehaved with a police inspector inside the police station,” said an officer.

Because Shinde seemed to be under the influence of alcohol, he was taken to Poddar hospital for medical examination. The doctors there stated in his medical report that he was drunk. Action was taken against Shinde. A case under section 112 of Mumbai Police Act was registered against him for misbehaviour with intent to provoke a breach of peace.

“Such behaviour on Shinde's part, who works in a uniformed force such as Mumbai police, is simply intolerable and irresponsible. This act tarnishes the image of Mumbai police. As per the powers of the Mumbai Police (Punishment and Appeals) Rules, Shinde's act was found to be indisciplined and irresponsible and he was placed under suspension. The order to this effect was accepted by him on February 28,” said a police officer.

The former IPS officer and lawyer YP Singh, however, felt that the action taken against Shinde was inadequate. “Because the medical report showed that the policeman was drunk, the cops should have booked him under section 85 of the Bombay Prohibition Act, which pertains to misbehaving in public in a drunken condition and is a cognizable offence. Section 112 of Mumbai Police Act does not consider drunkenness,” Singh said. He added, “Normally, such rough policemen are placed in side branches where they have least communication with the public.”
