Don't move Debt Recovery Tribunal to Vashi until further orders: Bombay HC to MoF

The Bombay High Court has stayed the decision of the Union Ministry of Finance (MoF) of shifting the Debt Recovery Tribunal (DRT) from Fort area to Navi Mumbai, until further orders. If shifted this would have been the first judicial body in Mumbai to move out of the city due to paucity of space in the existing locations.

A division bench of justices VM Kanade and MS Sonak also observed that it seems the decision to shift DRT (III) from South Mumbai to Navi Mumbai was not in order to cater to the larger public interest but to assist few office bearers of the tribunal, who are residing there. Earlier, the court had said: "Though on paper the move to shift DRT to Vashi from Fort, is right because of space crunch, but it is not a workable solution." The court stayed the decision of the ministry to shift while hearing a petition filed by the Bar Association of DRT which has challenged the decision of the Ministry to shift the tribunal to Vashi.

The Bar association opposed the move by which the ministry taking into consideration severe space crunch has decided to move DRT III to Vashi. The logic behind the decision is that for providing space, after inspection many buildings were found not suitable for housing DRT for various reasons.

The petition claims that ministry is spending 50% more than what is otherwise available in the vicinity of the present DRT in South Bombay. It is in the interest of justice, equity and fair play that the ministry be restrained from taking any decision to transfer the present DRT III.

Further, it prays that the ministry should be restrained from entering into and executing any lease Deed with regard to Vashi Premises and from finalising any proposal in regard to any premises at Vashi for DRT III presently situated in South Bombay.
