Don't degrade National Law University: HC to State

The Bombay High Court on Monday expressed displeasure over the delay by the state government in handing over the land allotted for setting up of the National Law University in Mumbai. It said: "National Law University cannot be degraded like this (sic)."

A division bench of Chief Justice Manjula Chellur and Justice NM Jamdar has given two weeks time to the government to expedite the process for handover of the land at Gorai and also provide proper infrastructure to the university that is operating from a premise in Powai at the moment.

The bench said: "Institutes like IIT and NLU, need a certain kind of treatment. Why do you (state) want such a university (NLU) in your city when you cannot provide proper infrastructure."

The court was also visibly upset after it was informed that there is a shortage of benches and chairs at NLU's present premises. "If this is not sorted, I will call the law secretary on the next date. I don't want such complaints of chair/bench and tables."

Government pleader Abhinandan Vagyani told the court that he would take instructions from the concerned department and try to resolve the issues raised. The bench responded by saying, "I want a practical solution."

The bench made these observations while hearing a public interest litigation (PIL) filed by Advocate Pradeep Havnur, which states that even when the Maharashtra National Law University (MNLU) Act was implemented in 2014, no steps were taken to allot 60 acres of land in Gorai as promised to University. Moreover, in the first year of the college, many bright students took admission in the institute but later dropped out as no proper infrastructure was available.

The University was to be set up in Mumbai, Nagpur, and Aurangabad. However, no efforts or steps are being taken for setting up a permanent campus for the university in Mumbai. The petition prays that HC directs the government to place all records with the court with respect to establishing the Maharashtra National Law University, and upon reading the records, direct them to ensure that the Act is implemented.
