DNA EXCLUSIVE: Maharashtra govt calls for ban on construction in red and blue floodline areas

To promote planned development in the jurisdiction of municipal corporations in the Mumbai Metropolitan Region (MMR) the state government has brought out draft comprehensive and integrated development control regulations (DCRs). These DCRs envisage ban on construction in the area between the blue flood line and red floodline.

The DCRs propose to make the areas between the river bank and blue flood line (flood line towards the river bank) a prohibited zone for any construction projects except parking, open vegetable market, garden, open space, cremation and burial ground, public toilet. Redevelopment projects in these areas may be permitted at a height of 0.45 m above the red floodline level.

Areas between the blue floodline and red flood line will be a restrictive zone for construction purposes. Any construction within this area may be permitted at a height of 0.45 m above the red floodline level. If the area between the river bank and blue floodline forms the part of the entire plot in the development zone, then FSI of such part of the land may be allowed to be utilised on the remaining land.

The DCRs also call for sufficient space for the construction of small tenements for economically weaker sections with carpet area specified by Maharashtra Housing and Area Development Authority (MHADA). The floor space index (FSI) under a new scheme of low-cost housing by MHADA on vacant land will be 2.50 on the gross plot area.

The draft DCRs will not be applicable to Brihanmumbai Municipal Corporation, Navi Mumbai Corporation, erstwhile areas of CIDCO included in the Panvel Municipal Corporation

For redevelopment projects under existing housing schemes of MHADA, the permissible FSI will be 2.50 on the gross plot area exclusive of the fungible FSI. For affordable housing scheme, the minimum plot area will be 4000 sq mt excluding the area under DP road and DP reservations with maximum permissible 3 FSI on the gross plot area including mandatory amenity space and open space for recreational purposes.

The MMR, spread over 4,355 sq km, consists of nine civic corporations — Greater Mumbai, Thane, Kalyan-Dombivali, Navi Mumbai, Panvel, Ulhasnagar, Bhiwandi-Nizamapur, Vasai-Virar, and Mira-Bhayandar. However, the draft DCRs will not be applicable to Brihanmumbai Municipal Corporation, Navi Mumbai Corporation, erstwhile areas of CIDCO (City and Industrial Development Corporation) included in the Panvel Municipal Corporation.

State urban development department officer told DNA, "The purpose is to implement the development plan and promote health, safety and general welfare of the present and future inhabitants living within the jurisdiction of these civic bodies." He informed that these regulations will be applicable to all construction projects, including change in design or making alterations to a building.Further, construction projects within 30 metre from the railway boundary will require a no-objection certificate from the Railways. Onthe other hand, development along the highways will be subject to the provisions of State Highways Act, 1965 and National Highways Act,1956. A service road of 12 m wide will have to be provided along state and national highways on both sides. The draft has proposed fire lifts be provided with a minimum capacity for 8 passengers and fully automated with emergency switch on the ground level.
