Disabled man v/s MSRTC: Bombay High Court ruling in favour of new stall

A disabled person running a cellphone stall at a Maharashtra State Road Transport Corporation (MSRTC) bus depot had been clamouring for a new licence for long. He had contended that his telephpne booth business dwindled with the rising use of cellphones and that he now wants to change his license to one that will allow him to sell food. MSRTC had been refusing to grant him this, until recently, when a Bombay High Court ruling ordered them to do so.

A division bench of Justice Naresh Patil and Justice GS Kulkarni, while hearing a petition filed by a 70 per cent disabled man, Devidas Jambhulkar, said: "Don't take away the livelihood of a person. He has been running the business for several years, and it is not his fault if a telephone booth lost relevance. Provide him some alternate mean to earn a living."

MSRTC had challenged the order of the Disability Commissioner staying the eviction notice issued to the petitioner and allowing him to sell food items in addition to running the public booth stall. During the last hearing, the court had observed: "You reserve seats for handicapped persons in your buses. Is it ethical then to evict a disabled person?" It had also urged MSRTC to consider the act as a social service.

Advocate GS Hegde, appearing for MSRTC argued that the policy does not allow selling food items stating that the stall was put up under a particular license and only for a limited period.

Jambhulkar has been running this stall for several years at Pune Railway Station's ST bus stand. He was served an eviction notice by MSRTC citing the redundnace of a telephone booth in today's time.
