Deserting hubby not cruelty, but ground for divorce: Court

While granting divorce to a 35-year-old man recently, the family court held that the ground of being deserted by his wife, without any reasonable doubt, doesn't amount to cruelty on the part of the 26-year-old woman, but is definitely a ground for seeking divorce. The court was presided over by principal judge Dr Laxmi Rao.

While granting divorce to a 35-year-old man recently, the family court held that the ground of being deserted by his wife, without any reasonable doubt, doesn't amount to cruelty on the part of the 26-year-old woman, but is definitely a ground for seeking divorce. The court was presided over by principal judge Dr Laxmi Rao.

The case dates back to December 11, 2007, when the two got married. According to the man's petition, his wife was a very much cordial woman and was taking care of the entire family very efficiently. Rather, till two-and-half years of their marriage, the wife's behaviour was too good. The man, in his petition, even described her initial behaviour to be "beyond expectation".
However, things changed after the first two-and-half years of their marriage. "At one point of time, the mangalsutra of the man's mother suddenly went missing and so he checked his wife's purse. To his surprise, he found the same in her purse. When he questioned her on the same, she got very irritated," read the divorce petition copy.

The petition further said that suddenly one day his wife went to stay at one of her friends' place and later went to her maternal place. Despite his requests, she refused to come back to her matrimonial place. "The husband kept on calling her and requesting her to come back. However, she refused. Thus, finally aggrieved, he filed a divorce petition against his wife for deserting him without any reason," the petition said.

After going through the petition, the court asked the woman to file a reply to the divorce plea filed by her husband, but there was no response from the woman. Thus, after going through the relevant evidence, the court accepted the man's plea and granted him divorce.
